We may update these Payment Terms from time to time. Please be sure to review these Payment Terms before completing any Commercial Transaction.

These “Payment Terms” apply to our commercial transactions with you, including any paid services you purchase from us (as defined below). We refer to any such services as "Paid Services". You should carefully read these Payment Terms to understand your rights and obligations, as these Payment Terms constitute a contract between you and PicPicAI Corporation or its subsidiaries from which you purchase Paid Services (collectively referred to as "Commercial Transactions"). By purchasing Paid Services, you agree to be legally bound by these Payment Terms. (See the "Who do I Contract with?" section below for an explanation of who you are contracting with in different circumstances.) If you do not agree to the Payment Terms, then you may decide not to complete the Commercial Transaction.

You agree to receive electronically all communications, agreements, and notices that we provide in connection with any PicPicAI product or service ("Communications"), including by email, SMS, in-app notifications, or by posting them on the PicPicAI website or making them available through any PicPicAI service or product. You agree that all electronic Communications we provide to you satisfy any legal requirement of a written communication.

Payment of Fees; Taxes

When you choose to purchase Paid Services from us and enter your payment information, you agree to the following:

  1. (i) You will fulfill your obligation to pay for the Paid Services by the due date;
  2. (ii) Any payment information you provide is true and accurate;
  3. (iii) You are authorized to use the payment method you provided;
  4. (iv) We have the right to retain all payment information and methods submitted by you and your issuing bank or applicable payment network, including all submitted debit and credit card information;
  5. (v) We have the right to use the established payment methods stored in your account and the information you provide to charge you for the Paid Services on the applicable payment date. Your payment guarantee and our right to collect payment include any taxes or delivery fees that you may be required to pay in connection with the products you purchase. In addition, you agree that you will be responsible for any credit card refund fees and any reasonable collection fees we incur due to your failure to make timely payments.

You agree to pay the fees for the Paid Services in the currency specified by PicPicAI (or any reseller or payment processor from which you purchase the Paid Services) when you enter into a Commercial Transaction and assume all risks associated with any change in value compared to other currencies. The specified fees for the Paid Services are inclusive of VAT and may include other taxes, delivery fees or similar fees applicable to your purchase. If we do not collect any applicable taxes or fees for your purchase, you acknowledge that you will be solely responsible for paying such taxes or other fees. The receipt provided to you reflecting your purchase includes VAT (if applicable), which is charged based on your location.

Our Paid Services prices do not include any third-party fees you incur while using the Paid Services, including but not limited to fees charged by your internet access provider, fees for any wireless carrier phone or data services you need to use the Paid Services, and fees for any other third-party applications or services you may use with the Paid Services; You are responsible for selecting and managing these other services and paying for them.

Changes in Fees

We may change the price of any Paid Services from time to time and add new fees and charges to reflect changes in business or legal requirements, but we will notify you in advance of any changes to recurring subscription fees. Price increases for the same Paid Service will not take effect before the end of your current billing cycle, unless otherwise specified in our notice, and at the earliest will take effect on your next payment for that Paid Service. If you do not agree to pay the new price or other applicable fees, you may choose not to renew your Paid Service subscription before the price change takes effect, with such cancellation taking effect at the end of your current billing cycle. For information on how to cancel your Paid Service subscription, please see "Cancellation" below.

Credits Service

The credits referred to in this agreement are a virtual tool of PicPicAI. Users can obtain them by participating in campaigns or purchasing them. By consuming credits, users can obtain services provided by PicPicAI. Unless otherwise stated in this agreement, users are limited to obtaining and using them within the PicPicAI software.

Credit service type

PicPicAI web app offers two types of credit services: monthly subscription credits and permanent credits. The credit services will be adjusted based on user demand, such as adding new credits or deleting existing subscriptions, and other changes. If there are upgrades or changes to the credits service, PicPicAI will inform you and ensure that the corresponding upgrade or change will not affect your existing benefits.

Credits Deduction Instruction

Different AI functions consume varying amounts of credits. Please refer to the Pricing page for more details.

Using PicPicAI AI functions to process or generate images will consume credits. Credits will be calculated and deducted based on the number of images and the number of consumption of the function. After processing an image, credits will be consumed, even if you haven't downloaded the image. So please make sure to save all AI-processed images promptly.

Repeatedly saving an unreprocessed image will not result in repeated deduction of credits.

Changes to Payment Methods and Account Information

You are responsible for ensuring that your account information, including your email address and all payment information (address, debit or credit card number and expiration date), is accurate and up to date. If you are not the Account Holder but you control the means of payment for a Paid Service account and wish to make any change to the payment method, you must notify us by contacting Customer Support and demonstrating to our satisfaction your control of the payment method used for the Paid Service.

If your credit card expires or the information is otherwise invalid, or you or another party controlling the payment method make changes to your billing account too close in time to when we charge for any Paid Service subscription (so we cannot reasonably act on your changes prior to billing), we will probably not be aware of this, and we will bill the current charges to the card we had on record; the continuation of your Paid Service subscription constitutes your authorization for us to do so, and you remain responsible for any uncollected amounts and any charges incurred by you or us as a result of billing to an invalid card.

Costs of Collection; Credit Card Chargebacks

In addition to the published fees for a Paid Service, you agree to pay any reasonable costs we incur to collect any unpaid or past due amounts, including reasonable attorneys’ fees and other associated costs. Delinquent payments will bear interest at the rate of 1% per month or the highest rate permitted under applicable law, whichever is less, from the payment due date until paid in full. If you purchase a Paid Service subscription with a credit card and then subsequently request your credit card issuer to reverse that payment, PicPicAI is charged a fee that may be a significant multiple of the amount we initially received. Accordingly, in order to enable you to pay relatively minor fees with a credit card, you acknowledge and agree that we reserve the right to suspend your ability to add additional Content to your PicPicAI service account until such time as you reimburse us the amount of the fee we were charged by the card issuer.

Who do I Contract With?

If you purchase a Paid Service from us, you will be entering into a contract with one of several PicPicAI affiliated companies, based upon your geographical location. Those provisions regarding contracting parties and governing law continue to apply to our contracts for the PicPicAI Service. If you elect to pay a third-party reseller or payment processing firm for any Paid Service, the contract regarding your payment will be with such third-party, but such third-party is not authorized to provide you with any contract terms or other assurances that affect PicPicAI’s obligations relating to our delivery of the Paid Service; our obligations to you are governed by the Terms of Service, Privacy Policy, and these Payment Terms.

How to Get a Refund?

We are committed to providing the best product experience and service to all our users. Before purchasing, you have a free version to test the functions. If you are not satisfied with the purchased services, you can get a full refund under our approved conditions.

PicPicAI provides 7 days money-back guarantee for annual/monthly subscriptions.

Within 7 days, we will refund the remaining credits in your account based on the unit price of the credits at the time of purchase. For example, if you purchase a permanent package of 200 credits, we will refund the remaining credits based on the unit price of the credits at the time of purchase, at $0.065/credit.

If it is more than 7 days after the purchase, we don't support processing the refund.

Dispute Resolution

The interpretation and dispute resolution of this privacy policy shall be governed by the laws of the mainland of the People’s Republic of China. If any disputes arise from this agreement, the parties shall make every effort to resolve them through friendly negotiation. If negotiation fails, you agree to submit the dispute to the Hong Kong International Arbitration Center (HKIAC) in accordance with its arbitration rules. The arbitration The award shall be final and binding on all parties to the dispute. If the arbitral tribunal rules that any provision or any part of these terms is unenforceable, the remaining provisions or parts of these terms shall remain fully effective. If you believe that our processing of personal information If the behavior harms your legitimate rights and interests, you may also choose to report it to the relevant government departments.
